Using the SIRENIS website and the services and products contained on it means acceptance by the users of these General Terms and Conditions and the regulations for use stipulated in the latest updated version. Therefore, it is important that the user reads these each time he or she visits the site. Each product or service’s specific conditions must also be read and accepted.

1. Introduction

On this website, SIRENIS offers information related to the kind of activities, products and services it sells. This website and its contents offer you information about the hotels that SIRENIS markets and manages. By accessing and using this website, you agree to submit to the conditions set out below, and so it is recommended that you read this section carefully before beginning. SIRENIS reserves the right to change, modify, add or remove part of these conditions at any time, and to make changes to the products and programmes shown on this site without previous notice. Therefore, it is recommended that you check for any possible changes periodically. 

2. Limitations of use

Limited to personal, and not business, usage. This website is for your personal use, and not at any time for business use. It is prohibited to modify, copy, distribute, transmit, reproduce, publish, market, sell or do any other action that may be carried out with the content of this website, even with the source cited, unless by written consent of SIRENIS.

The creation or design for yourself or for a third party of any website whose domain name is identified with any of the brands registered by SIRENIS or one of its group’s companies, including the hotels’ identifying names, will not be authorised in any way.

SIRENIS is not responsible for damage resulting from access, use or misuse of the website’s contents.

The use of this website does not mean that any agreement, contract or commitment, or labour, business or agency relationship exists between SIRENIS and the user. Any rights that are not expressly granted remain expressly reserved by SIRENIS. Online bookings on this website are excluded as they are regulated by the Information Society and Electronic Commerce Law and by the procedures that must be followed when entering into the agreement.

SIRENIS accepts no responsibility for the free exchange of information between users on its website. The liability for any statements provided on its website shall be held by the person making the statement.

8.-Jurisdiction

Applicable law. Any disputes arising in relation to this website shall be governed by Spanish law, and so the resolution of any disagreement that may arise with users with regard to the conditions of use and any other complaint related to the website’s contents and services, will be resolved by the Judges and Courts of Ibiza, and will be interpreted according to Spanish Law; parties expressly waive their own local or regional law and any other that may correspond to them.

III.- PRIVACY POLICY

1.- Personal data protection.
 
SIRENIS undertakes to fulfil the current regulations covering automatic data processing, specifically the Organic Law 15/99 regarding Personal Data Protection of 13 December (LOPD) and regulations stated in it, keeping to the following privacy policy:

With the aim of rendering the services offered at http://www.sirenishotels.com/, as well as offering customised products and services, improving business relations and managing requests made by our customers, SIRENIS will process its customers’ personal data automatically and for the purposes given below.

These personal data will be processed by SIRENIS in a file which is the company’s full responsibility and which has been registered in the General Registry of the Spanish Data Protection Agency.

SIRENIS informs Customers and/or Users that they may exercise their rights to access, rectify, cancel or oppose by writing to SIRENIS SERVICE, S.L. Edificio Sirenis, Calle d’es Cubells, 32, 07800 IBIZA, or by email to the following address: lopd@sirenishotels.com. It also states that consent for transferral and processing of a customer’s personal data can be revoked at this address.

SIRENIS informs the Customer and/or User of the purposes for which it will use the personal data stored on this website:

i.- Online booking forms
By completing the online booking form, each user accepts and authorises SIRENIS to use and process automatically the personal data supplied with the aim of carrying out the booking requested, offering customised products and services, improving business relations with our customers, carrying out statistical studies and sending advertising regarding products and services it sells; likewise, each user accepts and authorises the transfer of these data to companies included in the SIRENIS GROUP and partners for the purposes stated above (the list of companies belonging to the business group can be checked at the address stated previously). Likewise, customers making a booking are informed that their personal data and booking information will be transferred to companies that will manage the booking and also to the destination hotel, regardless of the country where these companies may be located, it being possible for international data transfers to occur, with the exclusive purpose of managing the booking and guaranteeing that it is carried out; therefore when completing the form, each user also accepts and authorises this international data transfer.
In accordance with that set out in the LOPD, a file has been created for the storage of these data, SIRENIS guaranteeing that it adopts all security measures to ensure their confidential processing, and in the case that users do not agree with the processing or transfer of their personal data, they can contact the addresses stated above, in writing.

ii.- Newsletter Form.
By completing the Newsletter form, the user accepts and authorises SIRENIS to use and process automatically the personal data supplied with the aim of offering customised products and services, as well as sending advertising regarding products and services it sells; likewise, by completing the form, the user accepts and authorises the transfer of these data to companies included in the SIRENIS GROUP and partners for the purposes stated above (the list of companies belonging to the business group can be checked at the address stated previously); by this, the user expressly authorises SIRENIS to send by email advertising regarding the products and services sold by SIRENIS.
In accordance with that set out in the LOPD, a file has been created for the storage of these data, SIRENIS guaranteeing that it adopts all security measures to ensure their confidential processing, and in the case that users do not agree with the processing or transfer of their personal data, they can contact the addresses stated above, in writing.
   
iii.- “Enter your CV” Form.
By completing this form, the user accepts and authorises SIRENIS to use and process automatically the personal data and information supplied so they can be transferred to MATUR S.L. with the purpose that they be incorporated into its file, which is also duly registered, in order to be used in the process of recruiting personnel at the companies belonging to the SIRENIS GROUP and partners (the list of companies belonging to the business group can be checked at the address stated previously); therefore, by completing this form, users are expressly authorising the transfer of their data to MATUR S.L. and to the companies belonging to the above-mentioned business group for the exclusive purpose of personnel recruitment.
In accordance with that set out in the LOPD, a file has been created for the storage of these data, SIRENIS guaranteeing that it adopts all security measures to ensure their confidential processing, and in the case that users do not agree with the processing or transfer of their personal data, they can contact the addresses stated above, in writing.

2.- Confidentiality.

SIRENIS will not reveal your personal data to any third party except those stated in previous sections.

SIRENIS guarantees that your personal data, as well as the server on which they are stored, will be handled confidentially, and also that it will ensure the data are given the security measures established in the Spanish regulations regarding data protection.

3.- Use of “Cookies”.

Some of the SIRENIS services use Cookies.

“Cookies” are pieces of text which a website can store in your computer.

The SIRENIS website uses “Cookies” to obtain the following statistical information: date of the visit to the website, the IP and origin of the visit.  This information is stored for a period of 30 days. 

These “Cookies” do not damage any element or files in the user’s or visitor’s computer.  If the user or visitor does not wish to receive these “Cookies”, they may be disabled in the Internet Explorer browser (please consult the instructions for each web browser).

IV. BOOKING CONDITIONS AND CANCELLATIONS

If you cancel before 48 hours before the arrival date: the hotel will return to you any deposit you may have paid.
If you cancel within this period or do not arrive: the hotel will charge the first night to the credit card left as a guarantee and, if the total has been paid, the amount for the first night will not be returned.
